| 摘 要： | 我国循环经济立法中确立了"总量控制制度"。从实施效果来看,总量调控制度对于抑制一些地方政府不顾本地环境容量和资源承载力的要求盲目新建、改建和扩建项目的冲动,发挥了非常重要的作用。但也存在缺乏"限批"制度的配套措施、政府责任机制缺失、其他相关立法的配套衔接不足等问题。为进一步推动节能减排,加快经济发展方式的转变,需要在相关立法中增加"限批"制度,建立对政府及其相关部门的法律责任机制,完善相关配套立法,提升总量调控制度在整个循环经济法体系中的制度整合功能,从而更好地发挥其实践效能。
