我国政府采购制度缺陷及完善——“亚奥公司”起诉财政部一案的启示

政府采购投标商“亚奥公司”起诉财政部一案，充分暴露了我国政府采购制度的诸多漏洞，主要表现在：我国现有的政府采购制度本身难以协调；政府采购缺乏有效的司法救济途径；政府采购制度的约束力软化；采购标的存在监管的“真空地带”。完善我国的政府采购制度，首先要贯彻落实《政府采购法》、进一步完善我国政府采购法规体系；其次要构建政府采购的风险预警系统、控制和防范政府采购风险；再次要积极探索政府采购手段的创新、促进政府采购的电子化。
