TRIPS与中国版权刑事立法的修改与完善

我国现行刑法基本规定了版权的刑事保护制度。但是随着中国加入 WTO,我国版权的刑法保护面临新的挑战。本文在分析 TRIPS 协定及世界各国家和地区的版权刑事立法的基础上,就中国加入 WTO 以后如何进一步完善我国版权刑事立法进行初步的探讨。     

破译打开"安全阀"的密码:保障措施的因果关系分析

保障措施被视为自由贸易的“安全阀”，根据GATT1994第19条和《保障措施协定》的规定，一个WTO成员采取保障措施，必须证明进口增长和严重损害或严重损害威胁之间存在因果关系（the Causal Link）。然而因果关系要从哪些要素上去分析？采用什么方法？程度如何？如何处理除进口增长之外的其它因素？[编者按]     

我国出口贸易应对国际保障措施研究

一、国际保障措施的来源 国际保障措施(Safeguard measures)俗称WTO规则的"安全阀",全称为"免受进口损害的保障措施".源自于美国贸易法中的"逃避条款"(Escape Clause),并由美国推动,被关贸总协定第19条认可.而第19条在长期的适用过程中,逐渐显现出规定过于简单,不易操作的弊端,甚至被有些国家滥用成了一种非关税壁垒.为了防止保障措施的滥用和加强纪律,才有了1994年的<保障措施协定>.后经过多轮谈判形成了由中的第19条与<保障措施协议>共同构成的WTO现行的保障制度,从而较完整的国际保障措施制度在WTO中得到确立.     

论WTO中贸易自由化和国内管制权的平衡——以GATT第20条必要性检验为例

必要性检验是WTO相关协定中的重要概念之一。对于成员追求国内政策目标与多边贸易规则交错的情形日益增加的冲突,WTO以必要性检验作为平衡成员的管制权与自由贸易的重要工具。其基本价值在于平衡WTO成员方所面临的两种潜在冲突的价值:一方面承认成员可以采取一定措施以实现政策目标,另一方面防止成员采取过度限制贸易的措施。GATT第20条是WTO协定中保障贸易自由化与国内管制权的重要工具,分析第20条中必要性检验的内涵和具体运用,对于厘清WTO其他协定中必要性检验的含义具有重要的指导和借鉴意义。     

中新自由贸易协定自然人流动规则评析

中新自由贸易协定是我国与发达国家达成的第一个全面的自由协定.协定中有关自然人流动的制度安排.较之WTO及我国其他自由贸易协定,有较大的改进.具体体现为:确定自然人的类型.明确相关术语;水平承诺自由化程度更高;深化了部门承诺;增加临时雇佣入境承诺;移民手续更便利;新增假期工作机制安排.     

WTO协定对我国国际投资法的影响

WTO协定开创了在多边贸易体制中调整国际投资间的先例 ,中国将正式成为一个在世界经济中起重要作用的资本输出大国。我国加入世贸组织后其多边协定对我国产生约束力 ,应重新审视我国有关外商法律、法规的实际作法 ,履行谈判的相应义务 ,进一步修改完善现有法律 ,加快对新领域的立法 ,使中国外商投资法与WTO多边协定的规定相适应

商业秘密属于WTO的《与贸易有关的知识产权协定》(即TRIPS协定)中"不公开信息"的重要组成部分,其范围包括行政相对人"提供给政府或政府机构的数据"和"未公开的实验数据".据此,保护行政相对人的商业秘密即成为我国政府的一项义务.新《商检法》有关规定的修订,正是实施这一义务的立法措施.但其中有关商检工作人员侵犯商业秘密的行为方式和性质的论述,值得商榷.     

第三国倾销制度初探

第三国倾销制度包含"代表第三国反倾销"和"请求第三国反倾销"两项内容。虽然WTO的反倾销协定之下的一般的反倾销条款构成"第三国倾销"规则的组成部分,但代表第三国反倾销和请求第三国反倾销与一般的国内反倾销仍有不同之处。中国外贸立法上的"第三国倾销"条款是不完备的,应参考国际立法和外国的立法,充实我国立法中第三国倾销方面的制度。
