我国司法会计鉴定存在的问题及解决途径

随着市场经济的发展，经济犯罪案件的数量和种类越来越多。在处理这些案件的过程中，司法会计鉴定起到了举足轻重的作用。然而，在司法会计鉴定的具体实践中尚存在认识不到位、资格认定不明确、鉴定程序不规范、法律责任不明确、人才缺乏等问题，急需寻找解决途径。

目前对于法人居民身份认定标准,相关研究并没有对其不同认定标准按比较统一的原则进行分类。现行优先标准主要对发达国家有利,发展中国家应从本国利益出发,重视日常管理和控制中心标准和受控外国公司标准,同时争取有利的协调规范顺序。

反垄断民事诉讼的法律经济学分析——以最高人民法院第79号指导案例为视角

近年来,我国反垄断民事诉讼案件逐渐增多,但囿于原告主体单一、法律适用混乱、赔偿数额不足等问题,反垄断民事诉讼制度难以充分实现对消费者权益的有效救济.本文以第79号指导案例为视角,建议在反垄断民事诉讼体系中引入集体诉讼机制,并构建原告拟制、律师激励、和解赔偿等具体制度,从而激励消费者维权,解决多重法律竞合,平衡双方诉讼能力,落实竞争政策的基础性地位.     

浅议自媒体视域下高校学生管理工作创新思考

近年来,随着网络技术的飞速发展和移动互联工具在大学生中的迅速普及,"无网不在"、"每日必网"迅速成为90后大学生基本的生活方式,学生管理工作受到更加严峻的挑战。本文通过对自媒体平台工具差异化比较研究,结合高校的具体情况,提出了运用自媒体工具推进学生管理工作创新的具体举措。     

基于成本优化的制造业生产物流装配线排序问题分析

为了降低制造业的生产成本，提高收益，在分析生产物流配线闲置和超载成本的基础上，采用粒子群算法对其进行优化，并利用模糊自适应改进惯性权值，通过实证研究表明该方法实用，可操作性强，可以有效降低制造业生产物流成本，具有广泛的应用价值。     

Emerging bicycle tourism and the theory of planned behavior

In this study, we investigated the process of travelers’ decision formation for bicycle touring as a form of sustainable tourism activity. We extended the theory of planned behavior (TPB), using personal norm and past behavior as predictors and the attractiveness of unsustainable alternatives as a moderator. Results of the modeling comparison showed that our extended TPB model was superior to the original TPB in predicting intention. Our results from the structural analysis revealed that the hypothesized paths linking attitude, subjective norm, perceived behavioral control, personal norm, and intention were supported; and personal norm significantly mediated the impact of subjective norm on intention. Moreover, our proposition that bicycle travelers’ decision-making process would differ based on their level of the attractiveness of unsustainable alternatives was generally supported. Overall, our results help us clearly understand the role of volitional and non-volitional processes, personal norm, past behavior, and the attractiveness of unsustainable alternatives in explaining the intention formation of bike traveling.

Does Managerial Behavior Determine Farm Technical Efficiency? A Case of Grape Production in an Economy in Transition

This study explores how farmers' managerial behavior in their production planning processes influences the economic performance of their farms, measured through input‐oriented and output‐oriented technical efficiency. A conceptual framework in which differences in managerial behavior were assumed to be due to bounded rationality was developed. The 3‐year means (2006–2008) from a panel data set on grape‐producing family farms in FYR Macedonia were analyzed. Technical efficiency was estimated with the nonparametric data envelopment analysis approach. The impact of farmers' managerial behavior was assessed in a second‐stage regression. The results suggest that bounded rationality in farmers' production planning decisions causes inefficiency. Copyright © 2011 John Wiley & Sons, Ltd.
