| 摘 要： | 分析了我国未成年人犯罪刑事责任的规定,指出,应把未成年人犯罪和成年人犯罪有效区分开来,为确定未成年人应负的刑事责任提供科学、合理的刑法依据;尽量缩短监禁的刑期,适当放宽缓刑的适用条件,尽量使用缓刑,重新构建我国未成年人刑事责任制度。

| Abstract: | The paper analyses the restrictions on juvenile's criminal liability,and it points out that we should distinguish juvenile delinquency from adult crime in order to provide some scientific and reasonable criminal basis for fixing juvenile's criminal liability.It is necessary to shorten the term of imprisonment,widen the applied requirement of probation properly and use the probation as possible as we can and reconstruct our system of juvenile criminal liability. |
