整体生态价值——经济法域价值取向之匡正与补充

学界对经济法域内基本价值取向的探讨大都遮蔽了这样一个事实,即或多或少地持一种“人类中心主义”视角。而晚近生态价值理论对此亦有矫枉过正之嫌,很容易滑向另一极端,即“生态中心主义”。本文所倡之整体生态价值,旨在消弭如上弊端,并以“公民环境权”为中介阐明整体生态价值与以人为本的科学发展观并不背离,仍旧符合可持续发展战略。

Whole Ecological Value——The Complement and Adjusting to the Value Direction of Economic Law

The discussion about the direction to the basic value of Economic Law almost covers a fact,which means,more or less,considering everything from the point of humanism.But nowadays,the theory of ecological value has been advocated frequently,and it's very easy to lead us from an extreme to the other one:focusing on the ecology too much but ignoring the ecology.In this essay,the purpose of advocating whole ecological value is to perish the disadvantages between the two extremes above,and explain that this value is conformed to the theory of humanism.
