| 摘 要： | 文章在阐释了我国农村环境现状基础上，诠释了环境保护与新农村建设的相互关系，指出环境保护是新农村建设的重要内容和必然选择。从环境法的视角，通过分析我国农村农业环境立法现状剖析了农村环境保护的四大困境：法律内容分散、管理条块分割、执法力量分化、行为主体分离；并从协调法律内容、完善立法体系，理顺管理体制、行使有效监管，整合执法力量、发挥部门合力，通畅沟通机制、促进公众参与五个层面提出了推进新农村环境法治建设的路径选择
