浅论我国地理标志产品的法律保护——通过鲶鱼标识判例进行分析

文章通过对美国鲶鱼标识贸易保护的判例分析，研究鲶鱼标识的立法和司法的相互结合、互为补充的运作机制，吸取鲶鱼标识判例中体现的立法原则和精神，为我国地理标志产品保护以及相关技术法规的立法和实施工作提供参考。

行动导向教学并不是一种具体的教学方法,而是以行动或者工作任务为导向的一种职业教育指导思想与策略,由一系列的以学生为主体的教学方式和方法组成。本文旨在从行动导向教学法的概念出发,对行动导向教学法的内涵进行分析,进而探讨行动导向教学法在《图形图像处理》课程教学中的应用,更好地实现《图形图像处理》课程教学与行动导向有机结合,全面地提升学生的专业技能和职业素养等职业能力。     

基于比较视角的大型国企集团改革发展研究——以上海仪电集团与重庆四联集团比较为例

大型国企集团的改革发展对进一步深化中国国企改革具有十分重要的标杆意义。通过实地调研具有共同产业基础的上海仪电集团和重庆四联集团，剖析这两家大型国企集团改革发展的不同路径以及产生差异的原因，有助于揭示大型国企集团除了需要体制机制性的生态环境的优化外，还应有其他共性的改革发展的新要求和新探索。     

Community entrepreneurship - cases and conceptualization *

As starting and managing a small business means both social and economic risk taking so is building a robust community a social as well as an economic endeavour. Such a community is a most vital context for entrepreneurship. If located in a remote area and if the environment is hostile cooperation is stimulated between firms and other community groups. Their success is especially ascribed to qualified community entrepreneurship, i.e. personal and innovative ways of building support for local autonomous entrepreneurs. An integrative approach to local economic development is illustrated by two successful, albeit contrasting, Swedish cases.

The cases are reviewed with the help of a conceptual framework that particularly points out the importance of local and global networking in both community and autonomous entrepreneurship. In a mixed economy such networks must be carefully managed and encompass linkages on, beside the market, institutional and political arenas. The very role of the community entrepreneur is to bridge these different settings through alert leadership, if required organized as a team.     

IPO定价与公司内含价值——基于常山药业的案例研究

如何对IPO公司准确定价是学术界和实务界广泛争议的热点话题。IPO定价准确性的评价依赖于对公司内含价值的判断，选择不同的标准确定公司的内含价值会得出IP0定价过高或过低的不同结论。本文应用可比公司法对常山药业的内含价值进行估计，使用四种可比公司乘数计算的结果表明公司实际发行价格高于公司内含价值，这意味着公司的发行价格存在一定程度的高估现象。与同期证券分析师对常山药业发行价格预测的平均估价水平相比，结果发现多数证券分析师由于过度乐观而高估公司内含价值。本文研究结果表明可比公司法具有计算简单、可操作性强等特点，不仅有助于一级市场中不同投资者对IP0公司的内含价值做出合理的估计，而且可以为二级市场交易中小投资者形成正确的投资决策提供依据，减少超额投资损失。     

Effects of two national environmental factors on e-commerce functionality adoption: a cross-country case study of a global bank

In order to offer new services and gain competitive advantages, e-commerce has been widely adopted, particularly in the banking industry. Unfortunately, despite the growing adoption of e-commerce in the banking industry, the issue that web-based B2C e-commerce functionality adoption varies between banks or a bank's branches across nations has not received sufficient attention. Many factors affect e-commerce functionality adoption. However, two national environmental factors (information infrastructure and demographics) are particularly important because they relate to the availability of technologies in use and the characteristics of customers, respectively. This research conducts a cross-country case study of a global bank's Beijing (China), Chicago (USA), and Dubai (UAE) branches to investigate how the two national environmental factors affect e-commerce functionality adoption. The specific objectives are to discover how information infrastructure (measured by number of PCs per 1000 people and Internet access cost) and demographics (measured by population composition and income) affect e-commerce functionality adoption of the global bank's three branches. Secondary data were collected for information infrastructure and demographics; additionally, focused interviews with these three branches' IT and business managers provided sources for answering ‘how’. The key finding demonstrates that the differences in e-mail ordering and online shopping adoptions between these branches are mainly attributed to proposed factors of population composition and Internet access cost, and the new factor of individual credit reference system. This research contributes to theory development in this emerging important research subject.

区域品牌建设探讨--温州案例研究

全球化条件下品牌竞争力日趋突出,本文在对比企业品牌、区域品牌、国家品牌的基础上,结合区域经济学、产业经济学等经济理论分析了区域品牌的特性,提出了发展区域品牌的必要性。“温州模式”下高速发展的温州民营经济带来了较强的区域品牌效应,这里以温州制鞋产业集群为例,对温州区域品牌建设进行了理论分析,并就相关影响因素进行了探讨。     

“默示同意”：合理博弈与不完善制度——郑百文重组过程中表决规则的经济学分析

当主持者对表决方式有选择余地时,那么他会根据自己的偏好,直接或间接影响表决结果,这是无法避免的,是在现有制度下的一种合理博弈,是有效的。如果他本身就是博弈的一方,则更会充分利用这种影响。而主持人对议案内容的偏好是广泛存在的,不可能通过消除偏好来消除影响。但是如果加强民主和监督,使主持者的选择余地尽可能缩小,即他只能选择社会承认的最优的“公平”规则才符合他自己的成本－－收益平衡,那么这样就使个人的最优选择与社会的最优选择一致,提供了制度上的改进办法。而在未有更高程度的民主和更有效的监督制度之前,只能容忍在现有制度内的博弈行为。所以,只有通过进一步加强民主和健全法制,进行表决规则的制度建设,才有可能得到更优化和更真实的表决结果。
