在公私合作制已经逐步发展成为世界潮流的背景下,作为推行这项新型制度安排的"后发国家",德国在该领域内后来居上,成果颇丰。其中《公私合作制促进法》的出台就是一项具有标志性的成果。该法通过对德国投资法律的修订,初步改善了开放式基金参股公私合作制项目的法律前提,但在公共基础设施基金的问题上,德国立法者的态度则相对保守。分析借鉴这些经验,对正在建设和完善市场经济法律体系的中国具有重要的现实意义。  相似文献

This article aims to identify gaps in public participation in land use planning to improve risk governance, using the case of the Great East Japan Earthquake (GEJE) in 2011. Overreliance on technical information and on the opinion of experts is occurring side by side along with negligence of local knowledge and lack of effective public participation in decision-making, creating a sense of overconfidence regarding scientific knowledge and new infrastructure's abilities to withstand future disasters. Using the case study method in GEJE, our research identified three main overall gaps in participation. Firstly, a lot of local knowledge from previous experiences was not incorporated into land use plans in the region even after similar events in the past. Secondly, there was technical information that alerted to possible risks for land use in certain areas, but this information did not impede development in risk areas due to lack of effective participation in the land use planning processes. Finally, Japan allows participation in many land use planning process, but some of the most important decisions, such as on the sitting of nuclear plants had little or any local participation. Thus, strengthening public participation in land use by closing those three gaps could improve risk governance and resilience of localities to cope with large natural and technological disasters in the future.  相似文献

Can benefit corporations be held accountable for delivering requisite public goods? An oft-cited criticism is that they cannot, but little empirical research exists to support that claim. Based on an in-depth case study of the oldest corporation to amend its governing documents as a public benefit corporation (PBC) under Delaware law, this article suggests that a company can be held accountable for delivering requisite public goods when external mechanisms are accompanied by an organization’s internal commitment to self-awareness, learning, and measurement. In the case in question, the company established a three-pillar structure focused on professional engagement, community support, and charitable giving built on a 6-year-old sustainability initiative, accompanied by an adaptive learning culture, and driven by top-down and bottom-up efforts. Current challenges include measuring impact and branding the PBC to grow the company’s business.  相似文献

Public pay telephones are fast becoming technological dinosaurs headed quickly toward extinction. In Thailand, however, the National Broadcasting and Telecommunications Commission (NBTC) has included the public pay phone as part of the Universal Service Obligation (USO) to ensure that all people in the country have reasonable access to a standard telephone service on request, and that payphones are accessible to all people on an equitable basis, wherever they live or carry on business. In spite of this, however, public pay phones and their revenue are also sharply declining due to the ever increasing encroachment of mobile phone technology. The researcher therefore undertook a study to empirically examine the key determinant factors for individual consumers using public payphones. A discrete choice model is employed together with the analysis of data from a 2011 national survey commissioned by the NBTC. Payphone usage is determined by the ownership of fixed phones, mobile phones and income which all play an important role with payphone being a necessary service for low-income people. Hence, NBTC should continue support through the USO fund and reassess the areas and groups of people who need this service in order to ensure that the USO policy is effectively and beneficially implemented.  相似文献

Based on a data set of 115 economies, this article empirically investigates the relation between public debt and economic growth. Using the World Bank’s classification for income groups, we initially find that those countries that present the lowest public debt are characterized by the highest economic growth, while the smallest growth rates are associated with the highest public debt. Nevertheless, this conclusion is tempered when we analyse the countries by income level: low-income countries have a different behaviour with respect to lower-middle, upper-middle and high-income countries. When using the IMF’s country classification, the results do not suggest a clear pattern in the public debt–economic growth nexus across different countries, but indicate a heterogeneous relationship between such key macroeconomic variables.  相似文献

Using intraday data, we identify the intensity of private information flow in the U.S. Treasury market. Our results show that the intensity of private information flow is highly correlated with public information shocks and higher for longer maturity bonds. More importantly, we find that bond price changes associated with high intensity of private information flow tend to be persistent, whereas those associated with low intensity of private information flow are more likely reversed. While public information and private information are the main determinants of bond price variations on days with news announcements, private information and liquidity shocks are important determinants of bond price variations on days with no significant events. Finally, we show that the depth of limit order book is inversely related to the intensity of private information flow. Nevertheless, informed dealers do not seem to use hidden orders to disguise their trading intentions.  相似文献

The importance of R&D investment in explaining economic growth is well documented in the literature. Policies by modern governments increasingly recognise the benefits of supporting R&D investment. Government funding has, however, become an increasingly scarce resource in times of financial crisis and economic austerity. Hence, it is important that available funds are used and targeted effectively. This paper offers the first systematic review and critical discussion of what the R&D literature has to say currently about the effectiveness of major public R&D policies in increasing private R&D investment. Public policies are considered within three categories, R&D tax credits and direct subsidies, support of the university research system and the formation of high‐skilled human capital, and support of formal R&D cooperations across a variety of institutions. Crucially, the large body of more recent literature observes a shift away from the earlier findings that public subsidies often crowd‐out private R&D to finding that subsidies typically stimulate private R&D. Tax credits are also much more unanimously than previously found to have positive effects. University research, high‐skilled human capital, and R&D cooperation also typically increase private R&D. Recent work indicates that accounting for non‐linearities is one area of research that may refine existing results.  相似文献

本文基于“隐性—显性”契约激励研究范式,探讨公司社会声望对高管薪酬的影响以及作用机制。本文选取2009—2017年间的非金融A股上市公司为样本,研究发现,拥有较高社会声望的公司,其高管显性薪酬较低。具体而言,公共地位较高的国有企业、具有较高市场声誉的民营上市公司,其高管薪酬平均而言分别比其他上市公司低4.97%和6.30%。进一步地,我们发现公司声望对我国高管显性薪酬契约存在两种作用机制:一方面,公共地位较高的国有企业,可以为高管带来较高的社会声誉和社会认可,满足了“公共服务”类高管的社会声望偏好,从而降低了显性薪酬的支付水平;另一方面,市场声誉较高的民营企业,可以为高管带来较高的职业声誉和未来职业利益,符合“以商为荣”类高管的社会声望偏好,使高管愿意接受较低的显性薪酬。本文的结论为公司声望作为一种有价值的资源,可以对高管显性薪酬形成议价能力提供了重要证据,揭示了公司声望对高管显性契约激励的影响路径;同时,为国有企业高管薪酬契约设计以及激励机制提供了一定启示。  相似文献

Nighttime lighting is an important public service that impacts human activities and promotes transportation and pedestrian safety. Of course, such services are not free and have been found to have negative impacts on the environment. Responsible stewardship of the built environment requires that efficiency and care in the delivery of services be taken, particularly in the context of sustainability concerns. A significant problem with existing urban infrastructure systems like street lighting is that they have evolved over time using rule-of-thumb planning standards. Given this, systematic assessment and re-evaluation offers much potential for enhancing the spatial efficiency of infrastructure but also the opportunity to explicitly account for environmental impacts in combination with safety and security. This paper applies a methodology for studying lighting in urban areas based upon the use of spatial analytics, including GIS and spatial optimization. Findings and results are reported for a study area in San Diego, California, highlighting current system configuration issues, method development and the potential long term benefits of systematic analysis of public sector services.  相似文献
